General Terms & Conditions of Sale


1. Interpretation
1.1 In these condition “Purchaser” means the person who offers to purchase the goods and whose name and address appear on the constituting such offer.
“Company” means AusCan Int. Water Purification Technologies( registered in Austria)
“Goods” means the goods (including any instalment of the goods or any parts of them) which the Company is to supply in accordance with these conditions.
“Writing” includes cable, facsimile transmission and comparable means of communication.
1.2 Any reference in these conditions to any provision of a statute shall be construed as a reference to that provision as amended, re-enacted or extended as the relevant time. 

2. Basis of Sale
2.1 An invoice will be deemed to be accepted if not queried within 7 days from the invoice date.
2.2 These conditions shall govern the Contract to the exclusion of any other terms and conditions unless otherwise agreed in writing by the parties to the Contract.
2.3 In entering into the Contract the Purchaser acknowledges that it does not rely on and waives any claim for breach of any representation concerning the goods unless such representations are confirmed in writing by the Purchaser.
2.4 Any typographical, clerical or other error or omission in any sales literature, quotation, price list, acceptance of offer, invoice or other document or information issued by the Company shall be subject to correction without any liability on the part of the Company.

3. Order and Specifications

3.1 The Purchaser shall be responsible to the Company for ensuring the accuracy of the terms of a any order (including any applicable specification) submitted by the Purchaser and for giving the Company any necessary information relating to the Goods within a sufficient time to enable the Company to perform the Contract in accordance with its terms.
3.2 The Company reserves the right to make any changes in the specification of the Goods which are required to conform with any applicable safety or other statutory requirements which do not materially affect their quality or performance.
3.3 No order which has been accepted by the Company may be cancelled by the Purchaser except with the agreement in writing of the Company.

4. Price of the Goods
4.1 The price of the Goods is fixed unless otherwise stated and agreed in writing between the parties.
4.2 All prices include Sales Tax unless the Goods have been granted zero rating by Customs and Excise. 
All monies due AusCan Int. Water Purification Technologies are to be in EURO Funds and must be paid through Austrian Clearing Banks.

4.1 Prices:
Prices are subject to change without prior notice.

5. Description of Goods
5.1 Goods are described as completely and as accurately as possible. As much relevant information is included as the Company feel is necessary to make an informed choice. All products have been carefully chosen for their suitability for the allergy market but the Company cannot guarantee that they will be suitable for all Purchaser since sensitivities are so individual. The Company make every effort to keep the prices as competitive as possible and reserve the right to amend prices without notice if required.


6. Freight & Packaging 
Shipments will be made FOB warehouse, Vienna, Austria. Freight will be added to invoices on orders shipped via DPD or Gebrueder Weiss.
Shipment will be made in any manner requested by the customer, if the customer will assume any additional transportation charges.
Prices include the costs of standard domestic packaging only. Crating and/or export packing is extra.

7. Cancellations or additions to order 
All orders are individually processed immediately upon receipt. AusCan Water Purification Tech. reserves the right to charge the customer for any cost incurred from either cancellation or change of order. AusCan Water Purification Tech. also reserves the right to consider all additions to existing orders as a separate and new order subject to the terms and conditions of sales as outlined herein.

7.1 Returns
All Sales Are Final. No exchanges unless notated otherwise.
All Returns including those for warranty consideration, must be shipped prepaid. Freight collect returns will not be accepted.
Minimum restocking charge is 25%. Goods must be in original container and in saleable condition to be considered for restocking.

8. Claims Policy
Any damage or shortages must be noted at the time of delivery. If damage or loss is noted by the customer while unpacking the shipment, the carrier must be notified immediately. 
AusCan Int. Water Treatment Tech. must be notified , in writing, including a copy of the carriers claim form, of any damage or loss within 7 days.

9.Warranty
All products carry a full manufacturer's one (1) year warranty. This warranty will cover repair and/or replacement of defective components only at the manufacturer's discretion, and does not cover damage or failure caused by misuse, labour or misapplication, or and act of God such as fire, earthquake, or other natural disaster. 
Extended warranties are as follows:
Automatic Control Valves - 2 years.
Media Tanks – 2 Years 
Feed Pumps - 2 years.
If within the above period of time, any products shall be proven to the manufacturer’s satisfaction to be defective, these products or components will be replaced or there price refunded at the manufacturer’s option.
AusCan Int. Water Purification Tech. will not be held responsible for any damage, or injuries caused by improper installation, or for misuse of any product distributed by AusCan Int. Water Purification Tech.
The foregoing warranty is exclusive and in lieu of all other express and implied warranties (except of title) including but limited to implied warranties of merchant’s ability and fitness for a particular purpose.
The manufacturer will not be subject to and disclaims:
(1) Any other obligations or liabilities arising out of breach of contract or of warranty.
(2) Any obligation whatsoever arising from tort claims (including negligence and strict liability) or arising under other theories of law with respect to products sold or services rendered by the manufacturer or any undertakings, acts, or omissions relating thereto.
(3) We will repair replace any defective components which the manufacturer deems "defective" associated with returns of said components. 
(4) Warranty does not cover shipping, labour or installation charges.
(5) Feed Water Requirements for AusCan Reverse Osmosis Filtration Units:

Feed Water Quality meets within the respective valid Country Drinking Water Standards.
Conductivity max. 2000 µS/cm (2000ppm TDS)
Industrial RO Units Total Hardness max. 25 °dH (177,95 mg/l Ca)
Water Temperature max. 40ºC (122ºF)
Water Pressure max. 690 kPa (100psi)

9.1 System Installation
All systems should be installed to meet local, state and federal plumbing codes and health department rules and regulations. We recommend that all equipment be installed by a licensed professional plumber or general contractor. If the homeowner chooses to take the project upon themselves they should have an understating of plumbing and experience with the codes, rules and regulations.


10. Venue
This agreement shall be governed by, construed and enforced in accordance with the laws of Austria, as it is applied to agreements entered into and to be performed entirely within such State. Any action you, any third party or AusCan Water Purification Tech.. bring to enforce this agreement or, in connection with, any matters related to this website shall be brought only in either the state or Federal Courts located in Baden, Austria, and you expressly consent to the jurisdiction of said courts. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. This is the entire agreement between the parties relating to the matters contained herein and shall not be modified except in writing and signed by or AusCan Water Purification Tech. corporate officers.

11. Privacy Policy
Your privacy is important to us. To better protect your privacy, we provide this notice explaining our online information practices and the choices you can make about the way your information is collected and used. This notice applies to all information collected or submitted on the AusCan Water Purification Tech. website.
The only personal information we collect is name, street address, city, state, zip code, email address, telephone number, and credit card information. 
We use the personal information collected from you to process the specific purchase you have requested. We may also use the information for communicating with you either by email or regular mail. Personal information we collect is not used for any other purpose and is not shared. 
We never use or share the personally identifiable information provided to us online in ways unrelated to the ones described above. 
To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, we have put into place appropriate physical, electronic, and managerial procedures to safeguard and secure the information we collect online.

Clean Water should be your main issue
Nowadays, many people realize that tap water is not safe to drink. But if you talk to people and ask them about this issue, most can only give a vague explanation of the problem.
